Before late Justice Minister Mutula Kilonzo passed away, he stepped up pressure on Uhuru Kenyatta and William Ruto telling them to stop their countrywide campaigns saying they will not be eligible to contest the presidency in the 2013 elections.
Mutula who had been threatened with a censure motion in parliament in what was seen as attempts to cut him down to size said before he was killed that, he was disappointed when the proponents of the motion eventually dropped their bid. However, he had been threatened with death by unknown forces before he was found dead. He was a great leader and dearly missed.
Mutula, who was also the justice and constitutional affairs minister had dared the wiper democratic party to kick him out, telling Citizen TV’s power breakfast show at the time, that he had been approached by over 20 parties following the planned censure move in parliament. Mutula had insisted that it would be wrong if Deputy Prime Minister Uhuru Kenyatta and Eldoret North mp William Ruto were allowed to vie for the presidency while crimes against humanity charges at the ICC hang over their heads.
On or around Jan 25, 2011 late Justice and constitutional affairs minister Mutula Kilonzo described former vice president Kalonzo Musyoka’s shuttle-diplomacy seeking the deferral of Kenya’s post election violence cases from the international criminal court to a local judicial mechanism as a political gimmick, with no legal basis, and one doomed to fail.
Kilonzo maintained that at no point did the cabinet mandate Kalonzo to embark on a series of meetings with African heads of state to seek support for deferral of the cases, asserting that the former vice president who was his party boss in ODM- Kenya was engaged in a futile exercise. In what was yet another sign of rifts within the coalition government, Mutula told Kalonzo to focus his energies on judicial reforms and the establishment of a credible local judicial mechanism to convince the ICC that Kenya is capable of handling the post election violence cases.
